- General Provisions
I.1 The Customer declares to have read the terms and conditions applicable to the Baby Prestige Order placed by the Customer to Baby Prestige and accepted them without reservation. Baby Prestige reserves the right to modify these terms and conditions subject to individually advise Clients. These changes will apply to current orders on the condition that the Customer due notice has not disagreed within 8 days of the receipt by the Customer of changes.
I.2 The services offered by Baby Prestige benefits consist in providing services to the person, and especially family services (the “Services”). These benefits are described in the brochure and on the website www.baby-prestige.com
- Description of Services
The benefits conferred by the Customer to Baby Prestige are detailed in the order (the “Order”). This order describes in particular the price of the delivery and the implementing rules of the Services on the duration, timing and location of the services provided.
III. Price and payment terms
III.1 The fixed price, firm and final of the Services is established according to the price in the Baby Prestige brochure and on the website www.baby-prestige.com. Taxes are included. The price is payable when the Order is placed. Payment can be made by cash, by check to Baby Prestige by Chèque Emploi Service or by bank transfer to the account of Baby Prestige whose details appear on the invoice. The invoice is issued in duplicate for all services, and a copy is given to the customer upon receipt of the Order.
III.2 The Service Provider reserves the right to unilaterally change the price of the Services at any time, especially in case of rising costs, provided that, in case of increase in prices after the Order, only the price fixed in date of this Order shall apply to the Customer.
1. Conclusion of the Order
The Order is definitely concluded on the date of signature by the Customer, who passed it to Baby Prestige. Any request for modification of the Services ordered by Customer shall be subject to acceptance by Baby Prestige.
2. Duration of the Order
The Order is entered into for the duration stated in the order.
3. Performance of the Order
Baby Prestige is committed to provide the required Services in accordance with these terms and conditions contained in the Order. Baby Prestige is prohibited from disclosing information about the client or his property which he had access in the performance of the Services.
VII. Breach of the Order
The Service Provider can not be held liable for non-performance or improper performance of its obligations due either to the fact of the Customer, the fact is insurmountable and unpredictable one third, or to a case of force majeure.
VIII. Provision of staff
To perform the Services, Baby Prestige will involve one of its employees at the service of the Customer. Baby Prestige’s employees remain under the subordination of Baby Prestige that will provide them with the necessary equipment to perform the Services. The overall coordination is ensured by Mrs. Lucinda De Cicco, President of Baby Prestige. Baby Prestige can perform at the beginning of the Services, with the Client, an inspection of the workplace. Baby Prestige reserves the right to replace the employee performing the Services at the Customer’s by any other person with the same skills if it deems necessary. Baby Prestige will promptly notify the Customer.
- Dispute resolution
Any complaints should be addressed to Baby Prestige. In case of failure of the claim request, the Customer may submit the dispute between the mediator to Baby Prestige (include contact information) who will try, independently and impartially, to bring the parties in order to reach an amicable solution. In the absence of agreement, any disputes or litigation concerning the interpretation and implementation of the Services or the Order, will take place, if the plaintiff requires so, at the Court linked to the defendant’s home address or place of performance of the Services in accordance with Articles 42 and 46 of the Code of Civil Procedure or, at the Customer exclusively, the court of the place where he lived at the time of the conclusion of the Order.
